What this Agreement Covers

This Agreement governs your use of the Site and the Hitch Starz® LLC service (the “service”). You understand that by using the Site and the Service, you have agreed to the terms and conditions of this Agreement and you agree to use the Site and the Service solely as provided in this Agreement.

Intellectual Property Rights of Hitch Starz® LLC and Third Parties

Hitch Starz® LLC is committed to the appropriate and legal use of the intellectual property of others, and we require our users to behave similarly. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs and written and other materials that appear on the HitchStarz.com Site (collectively the “Contents”) are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by Hitch Starz®LLC.

Hitch Starz® LLC is the owner of the Hitch Starz® trademark; other trademarks made available through this Site, including logos, slogans, color schemes and design trademarks, are licensed for use by HitchStarz.com from third parties (the “Licensed Marks”). By using the HitchStarz.com Site, you agree to limit your use of Licensed Marks to uses that are directly related to such third parties and to comply with any restrictions or conditions imposed on the use and access of the Licensed Marks by the third parties. HitchStarz.com will notify you of such terms if your usage is in violation of such terms.

Generally, products created using images available on the Site should not be resold commercially. In the event that you wish to resell such products, you agree to contact HitchStarz.com and verify the legality of reselling such products prior to doing so.
Designs created using the text tools and images available through the Site are in no way the exclusive property of the customer’s who assemble such designs.

HitchStarz.com retains the right to display such designs or offer them (or variations of such designs) to other customer’s at it’s own discretion and without prior notice.

Additionally, HitchStarz.com has the sole discretion to reject any order that is considers libelous, defamatory, obscene, profane (according to standards established by the FCC), portraying irresponsible use of alcohol or other substances, advocating persecution based on gender, age, race, religion, disability or national origin, contains explicit sexual content or is otherwise inappropriate for HitchStarz.com production.

You agree to not use HitchStarz.com’s Service to create any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous of another’s privacy, hateful, or racially, ethnically or otherwise objectionable, or that infringes on the patent, trademark, trade secret, copyright or other proprietary rights of any third party.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

How can you opt-out, remove or modify information you have provided to us?

To modify your e-mail subscriptions, please let us know by modifying your preferences in the “My Account” section. Please note that due to email production schedules you may still receive emails which were already in production prior to your preference change.

Hitch Starz® LLC has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. Anti-Sweat Shop Policy

Hitch Starz® LLC and HitchStarz.com supports high standards for manufacturing labor conditions. Accordingly, we seek to work with suppliers who promote such standards within their operations. HitchStarz.com relies upon referrals, reputation and personal inspections to identify such vendors.

Payment Policy

HitchStarz.com accepts online payment via Visa, MasterCard, Discover, American Express, Debit Card and Paypal. If you would like to pay by money order, please submit your request by e-mail. Sorry, we are unable to accept personal checks.

HitchStarz.com also accepts payment via purchase order for qualified customers. Invoices may be paid by company check, credit or debit card.

Shipping Policy

All shipments of in-stock items are processed within 3 business days. Custom designed faceplates are shipped within 2-3 weeks. If ordering custom designed faceplate(s); your order will be shipped together, along with all in-stock items. All orders shipping within the USA will be charged the proper shipping charges; based on the destination. Optional shipping methods (i.e. 2 days shipping) is also available for an additional charge. You will receive an email confirmation containing your USPS tracking information when your order is processed and shipped from Our fulfillment facility.

Hitch Starz® LLC primarily uses USPS Priority Shipping (2-3 days) to deliver products. SHIPPING AND HANDLING is to one address only and will only be delivered to a physical street address. Sorry, we can not ship to PO Boxes or APO/FPO addresses. Delivery times may vary during the holiday seasons.

Once the product has been shipped from Us, the carrier is then responsible for the shipped product(s), including estimated time of arrival and final condition. If there has been damage to any of the products during shipping, please contact the carrier within 3 days of the delivery of your order. Please be sure to provide the carrier with the packaging and a copy of your emailed receipt-of-purchase to file a claim.

Return Policy

We sincerely want you to be happy with your purchase, so we will gladly accept returns for refund or exchange for up to 15 days from proof of purchase (online orders only).

Please email us to get a Return Authorization Number before shipping any product(s) back. Returned product for any reason must have the Return Authorization Number clearly marked on the outside of the packaging or it will be refused. If you are returning a defective product; in your email to us, please be sure to include details as to what the concern is with the product. Any package returned without a Return Authorization Number (RA) will not be accepted or credited. It is the original purchaser’s responsibility to ensure that all returns are adequately packaged, insured and tracked.

Product must be shipped back in unopened original packaging, be in re-sellable condition, and properly packaged to avoid damage of the returned item. We cannot accept returns of items which have been opened/used or for any custom/ personalized items, unless deemed defective as determined by Our Quality Control Department. There is a 25% restocking fee for all refunds of in-stock items. Refunds will not include any shipping charges nor will any shipping charges be refunded for items returned for refund and/or for any order that is canceled after your order has been shipped.

Cancellation Policy:

For Standard Delivery orders, you may change or cancel your order within 30 minutes of submitting your order online.

For Rush Delivery orders (any order requiring faster delivery than a Standard Delivery order), you may not change or cancel your order after submitting your order online.

Limit of HitchStarz.com’s Responsibility

Hitch Starz® LLC will only be responsible for acting on those instructions sent to HitchStarz.com that actually are received and does not assume responsibility for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of any orders you send. HitchStarz.com is not responsible for any losses or delays in transmission of orders arising out of the use of any Internet Access Service Provider or caused by any browser software or any computer virus or related problem that may be attributable to services provided by any Internet Access Service Provider. HitchStarz.com is not responsible should you give incorrect instructions or if your credit card payment is not processed by your credit card company.

The information and materials contained in this Site, including text, graphics, links or other items, are provided “as is” and “as available”. HitchStarz.com does not warrant the accuracy, adequacy or completeness of the information and materials on the Site and

expressly disclaims liability for errors or omissions in this information and materials. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose or freedom from computer virus, is given in conjunction with the information and materials.

In no event will Hitch Starz® LLC be liable for any damages, including without limitation, direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this Site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Hitch Starz® LLC or representatives thereof, are advised of the possibility of such damages, losses or expenses.

Indemnity

You agree to defend, indemnify and hold Hitch Starz® LLC and its affiliates harmless from and against any and all claim, damages, cost and expenses, including reasonable attorney’s fees, arising from or relating to your use of HitchStarz.com Site and the Service, your violation of this Agreement, or your violation of any rights of another.

Governing Law

This Agreement shall be governed by the laws of the The State of California and, where applicable, by federal law.
